About the Case:
In June 2022, the Plaintiff, 45, had a peritoneal dialysis catheter placed and was to receive training to perform her peritoneal dialysis at home through a Central Fort Worth Dialysis clinic.
In July 2022, the Plaintiff and her husband arrived at the clinic and entered the clinic about a minute behind a nurse. Upon entering the treatment room, Plaintiff sat in a dialysis chair, where the nurse cleansed the catheter and connected her peritoneal catheter to the cycler. Immediately upon connecting the catheter to the cycler, the nurse hit start, and at about that same time, the Plaintiff noted the machine was set to “prime” and advised the nurse of the same. The nurse told her that all four tubes had a different purpose, and she allowed it to prime, stating that it was an acceptable procedure.
The Plaintiff told the nurse to disconnect her from the cycler. While the nurse seemed hesitant to do so, the Plaintiff was adamant, so she finally acquiesced. The machine began alarming, and the Plaintiff’s right arm went limp, her left arm became weak, she began experiencing shortness of breath and was in severe pain.
The nurse eventually went to get her nurse manager. The nurse manager administered oxygen and asked the Plaintiff where she was hurting. The nurse manager placed the Plaintiff on her left side and raised her leg. The center called 911, and EMS arrived. The Plaintiff arrived in the emergency room with complaints of severe chest pain, shortness of breath, abdominal distention, and abdominal pain. CT imaging confirmed free air within the abdominal cavity, and the Plaintiff remained hospitalized for 8 days as a result of the incident.
