Congratulations to Advocate Capital, Inc. friend and client David J. Hoey on being named Attorney of Month in the Greater Boston Edition of Attorney at Law Magazine. Court: Middlesex County Superior Court - Verdict: $14, 447,905, including punitive damages. The plaintiff died of heart failure following acute renal failure due to being unattended for days at a time; she suffered from bedsores, splenic abscess, septic shock, untreated urinary tract infections, and fecal impaction related to neglect before she died. Johnson v. Kindred Healthcare, Inc., et al.
Court: MA Supreme Judicial Court – David argued on appeal that health care proxies are intended by statute to cover only “health care decisions” and that a power of attorney would be required to execute any binding arbitration contract. The MA Supreme Judicial Court remanding the case to Plymouth Superior Court for trial on the merits.
