Congratulations to our friends David Pierguidi and his team at the Law Offices of David Pierguidi PC on the recent $1,000,000 settlement they reached on behalf of their client in New York City.
The case involves a then fifty-four (54) year old woman who had advanced-stage ovarian cancer. On March 3, 2016, she underwent a debulking surgery with hysterectomy. During which, the Plaintiff asserted the surgeon improperly used the Bovie Cautery and/or Argon Beam Coagulator to remove and address cancerous nodules in the Decedent's colon.
The Decedent left the hospital on March 8, 2016. On March 10, 2016, the Decedent's family called the hospital, stating she was experiencing pain and chills. A fellow physician prescribed oxycodone for the Decedent while also giving her family the option of bringing her back to the hospital.
The Decedent returned to the hospital on March 15, 2016, suffering from septic shock. She underwent additional surgery to repair the damage incurred during the initial surgery. Three (3) "surgical defects," approximately one (1) inch in size, were found; two (2) on her colon and one (1) on her small intestine. A fourth perforation was found on the Decedent's sigmoid colon during follow-up surgery on March 31, 2016.
The Decedent underwent a total of six (6) surgeries and remained in the hospital for four (4) months with chronic sepsis, rectovaginal fistula, and a Stage IV sacral ulcer before succumbing to her injuries on July 28, 2016.
On September 7, 2018, David's office filed a complaint on behalf of the Decedent's Estate. The case recently settled for $1,000,000 for the pain and suffering sustained.
