Congratulations to our friends and colleagues at Harper, Evans, Wade & Netemeyer on this recent settlement in a motor vehicle case for which the insurance company initially denied all liability.
This case sprang from an automobile accident in Boone County, Missouri. The injured Plaintiffs were not at fault in the accident. The Defendant attempted to make a left turn from the southbound lane, crossing the centerline. The female Plaintiff driver swerved in an attempt to avoid the impending collision at the same time the Defendant re-corrected his vehicle.
Prior to the involvement of Ron Netemeyer and Jill Elsbury on the Plaintiffs’ behalf, the Defendant’s insurance carrier claimed that the Plaintiff driver was at fault, or at the very least, was comparatively negligent. Once retained, HEWN counsel immediately filed a lawsuit against the Defendant’s insurance company. Shortly thereafter, it was as agreed between the parties that the Plaintiffs had no negligence in this accident.
As a result of this accident, the female driver and her male passenger suffered significant injuries. The male passenger sustained fractures to his tibia/fibula & ankle, along with lacerations to his head, throat & elbow. The female driver suffered with fractures to her right arm, leg, ankle, and her foot, and abrasions to her head.
The male plaintiff had $93,497.27 in medical bills and the female driver had $185,718.08 in medical bills. Rigorous negotiations resulted in a settlement in the amount of $1,125,000 without the necessity of a trial.
We see and hear every day that we are “in good hands” and that insurance companies are “on our side.” Clearly, that is not the case and thanks to the tireless work of trial lawyers like Ron Netemeyer and Jill Elsbury, injured citizens can obtain the justice they deserve.
