In October 2018, Susan Hutchison and Chris Stoy of Hutchison & Stoy, PLLC tried a case in Tarrant County against a Dallas based insurance defense law firm. The team obtained a verdict for $1.13M for their client after a long, hard-fought, two-and-a-half-year battle.
On January 21, 2016, the plaintiff was at his place of employment as a shipping supervisor. A truck owned by KLD arrived and the driver noticed that something was wrong with the cargo door. The driver asked the plaintiff to see if he could determine what was wrong. When he stepped into the box area of the truck, the overhead door fell on him causing significant injuries. These injuries included lower back, left shoulder, neck and most significantly mild traumatic brain injury.
Due to his injuries and the effect the brain injury had on their client’s personality, Chris and Susan had to discover his story so they could tell it to the jury. The team employed techniques they learned at the Trial Lawyer’s College in Dubois, Wyoming. These techniques allowed the lawyers to tell the stories of the specific harms and losses that allowed the jury to relate to the plaintiff’s injuries.
After seven days of trial, a Tarrant County jury returned a verdict of $1,134,000.00. The verdict was distributed 90% liability on KLD and 10% liability on the driver. The plaintiff will never be the same person he was before this incident, but the jury’s award validated his losses and will allow him to move on with his life.
