Plaintiff and his companion returned home after a night out. As they approached the security gate at their residence, the on-duty security guard demanded the Plaintiff step out of the vehicle. Plaintiff declined to comply and instead questioned the guard’s request. Believing that the Plaintiff was about to drive away, the security guard reached into the vehicle to grab the keys from the ignition. In response, the Plaintiff tried desperately to drive away from the property. The security guard then fired shots into the vehicle, one of which struck the Plaintiff on the head.
During discovery, it became apparent the security company failed to properly train their security guards. The company instructed their security guards they had the same authority as police officers and were allowed to detain a private citizen for up to 60 minutes. This training was contrary to Nevada Law.
As a result of the Defendants’ negligence, the Plaintiff sustained a severe and permanent brain injury, is now legally blind and will require medical care for the remainder of his life. His companion who witnessed the entire event first hand now battles Post-Traumatic Syndrome. Mr. Cogburn skillfully resolved this case through a confidential settlement shortly before trial.
