According to Amanda Bronstad of Law.com, Johnson & Johnson recently voluntarily recalled sunscreens that contained low levels of benzene, which is a chemical that is known to be a carcinogen. All of the sunscreens were Aveeno and Neutrogena aerosol sprays.
So far, there have been nine lawsuits filed against Johnson & Johnson for “consumer fraud, unjust enrichment and breach-of-warranty claims.” There have not been any personal injury claims, but product liability cases may be filed in the near future.
In May, Valisure, an independent pharmacy, did testing and found high levels of benzene in over 70 sunscreens and similar products. R. Jason Richards, of Aylstock, Witkin, Kreis & Overholtz, who filed some of the lawsuits, says that while the recalls are a positive step, he expects there will be more recalls coming because of the small number of products Johnson & Johnson recalled relative to the number of products that Valisure found to contain benzene.
