According to Law.com, some of the attorneys who sued Johnson & Johnson over their aerosol sunscreen are questioning the proposed class action settlement that was negotiated with J&J. The sunscreen recalled five Aveeno and Neutrogena products in July of 2021.
The class-action settlement was proposed months after the July 2021 recall.
The first hearing in the multidistrict litigation had at least three plaintiff attorneys raising concerns about their lack of involvement. Plaintiff attorneys also mentioned their lack of access to the documents about the settlement.
At the multidistrict hearing, many plaintiff attorneys knew nothing about the settlement. According to some of the attorneys, it seemed two firms were consulted in the potential settlement.
The judge acknowledged the concerns at the hearing of the nonsettling lawyers. The judge also said he would schedule a preliminary approval hearing for the middle of February.
Class action lawsuits were filed against Johnson & Johnson after their sunscreen recall. The sunscreen has a dangerous level of a known carcinogen, benzene. The company launched a refund program for consumers who bought their sunscreen.
