On August 6, 2021, California trial attorneys Daniel Kramer and Teresa Johnson of Kramer Trial Lawyers received a $12.6M verdict for their client. The plaintiff, a lighting technician, was injured while accessing a broken hatch door at a strip mall in Riverside, California.
Two years before the incident, the property owner and manager were made aware that one of the rooftop hatch doors at the strip mall was broken and missing a spring. Even though this door presented a clear danger, the owners did not make repairs, and the plaintiff was injured while checking the exterior lights.
As a result of his injuries, the plaintiff had to undergo two spinal fusion surgeries, and likely requires future shoulder surgery. The nature of his injuries suggests he will also need surgeries at the adjacent levels in his spine in the future. Due to the serious nature of his injuries, the plaintiff ultimately stopped working by October of 2016.
The jury awarded the plaintiff past and future damages for lost earnings, medical expenses, and pain and suffering damages. The jury found both the property management company and property owner at fault for the faulty hatch door.
