Within two weeks, Ms. Cushman was dropped by nursing home staff and fractured her clavicle. The injury inhibited her from participating in therapy and her condition worsened. She was in constant pain, 10 out of 10 on the pain scale according to every entity outside the nursing home, yet no pain was documented by the nursing home staff. Ms. Cushman’s family testified that she displayed classic signs of neglect and mistreatment including dehydration, malnutrition, infection and sepsis. They testified that when they visited her, she never received liquids or pain medications, and was found lying in soiled bedding. The nursing home staff failed to recognize and treat Ms. Cushman’s sepsis and urinary tract infection, which resulted in her death. The jury verdict included punitive damages against the owner of Ballard Nursing Center as well as the owner’s management company, holding company and the nursing home facility.
