According to Nate Raymond of Reuters, the state of Missouri and Trinity Industries have reached a settlement of roughly $56 million in a class action claim filed by the state. The state claims that Trinity changed the design of its guardrails without notifying them. The changes to the guardrails made them dangerous and in need of removal and replacement. The company has not admitted any fault.
Raymond reports that the settlement will reimburse the state of Missouri for locating the unsafe guardrails and replacing them and the legal and administrative costs associated with filing the claim.
This claim is not the first filed against Trinity for the changes to their ET Plus guardrail system, but it is the first to settle successfully.
Raymond states, "The state's Department of Transportation removed the ET Plus from an approved products list following the allegations against Trinity, and 30 other states followed, plaintiffs' lawyers say."
