Congratulations to Attorney Minh Nguyen and his team on the recent $5.4 million verdict they obtained for their client, who was injured while shopping for an All-Terrain Vehicle (ATV).
In February 2022, the plaintiff was shopping for an ATV. He went to the Del Amo Motorsports store in Paramount, California. A salesperson showed him a particular CF Moto ATV with a winch mounted on the front. During the demonstration, the salesperson activated the winch while the plaintiff was holding onto the hook. His right index finger was pinched between the hook and the fairleads, causing a significant crush injury that led to his right index finger requiring amputation.
The plaintiff claimed that DAMLA, Inc. is vicariously liable for its employee’s negligence in activating the winch while he was holding onto the hook.
The defendant conceded negligence but argued that the plaintiff was up to 50% comparatively negligent for not heeding the salesperson’s warning not to hold the hook and the warning on the hook itself not to hold it.
The plaintiff was diagnosed with Complex Regional Pain Syndrome 2½ years after the incident. The defendant disputed the diagnosis of CRPS.
Ultimately, the jury assigned 88% harm to Del Amo Motorsports and 12% harm to the plaintiff. The plaintiff was awarded $5,465,508 for past and future economic and non-economic losses.
