In October 2013, Suzuki implemented the recall and stated their reasoning for the delay: "I believe that, as long as the timing of the first report is known, the details thereafter can be omitted. “After numerous meetings in a short period of time, the cause of the brake failure could not be identified, but once known, the recall was initiated. To minimize liability, Suzuki filed for bankruptcy in November 2012. A new corporation, Suzuki Motor of America, Inc., was formed, with top officers retaining their positions. This strategy allowed them to purchase assets while limiting product liability.
The case first went to trial in 2018, resulting in a $7.5 million verdict for the plaintiff. However, Suzuki appealed and successfully had the judgment reversed due to evidence-related errors.
