According to Public Justice, the Forced Arbitration Injustice Repeal (FAIR) Act (H.R. 2953) was reintroduced in April 2023. The FAIR Act would allow civil rights, consumer, and employment cases to be heard publicly in court as opposed to being forced into arbitration.
The act would help hold corporations accountable for their actions instead of allowing them to continue to silence the complaints that are made against them for wrongdoings like sexual assault, wage theft, and racial discrimination.
Public Justice states, "While it would not fully ban arbitration, the FAIR Act would make these clauses voluntary, giving people an opportunity to choose whether or not they’d like to settle outside of the courts. Without the passage of this Act, corporations will have no incentive to follow the law or act fairly, and they will continue avoiding accountability and exploiting America’s workers and consumers."
