Congratulations to our friend and client Nicholas C. Rowley and Courtney Rowley with Trial Lawyers for Justice, who were awarded by a jury on behalf of their client $29.5 million in a medical malpractice case.
The jury awarded Attorney Nicholas and Courtney Rowley’s client, the family of Carrie DeJongh a $29.5 million verdict against Sioux Center Health and Slice in the wrongful death suit.
Plaintiff Carrie DeJongh, a 40-year-old wife and mother of four children, died after having an allergic reaction in a routine C-T scan. The plaintiff had an allergic reaction to the contrast dye she was given for her C-T scan. Dr. Roy T. Slice who administered her scan gave her Benadryl but didn’t take her vital signs or administer epinephrine which could have reversed her anaphylactic shock.
Mr. and Mrs. Rowley on behalf of their client, originally offered to settle with Sioux Center Health and Dr. Slice for $1.35 million before the trial, but the defendants declined the settlement offer.
The case went to trial and due to the diligence of Attorneys Nicholas and Courtney Rowley, the jury awarded the family of Carrie DeJongh $29.5 million. The defendants claimed they were entitled to a new trial for many reasons, including that Mr. and Mrs. Rowley had influenced the jury. Defendants claimed: The jury’s award for damages “is excessive, appearing to have been influenced by passion or prejudice” and “was not sustained by sufficient evidence in the record.”
The defendants have not been granted a retrial.
