According to The National Law Review, a New Jersey state court certified a class-action lawsuit against Middlesex Water Company. The plaintiffs in the lawsuit are seeking damages from their local water company.
Plaintiffs allege that the county's drinking water had unsafe Perfluorooctanoic acid (PFOA) levels. The company advised consumers should use bottled water, buy water filters, and visit their doctors for medical monitoring. The company expected consumers to pay for extra expenses to drink water safely but still wanted them to pay their monthly water bill.
Plaintiffs joined together with a class-action lawsuit to recover the extra expenses due to the unsafe drinking water. Middlesex Water Company challenged the class action certification arguing that each plaintiff's claims were different based on the precautions the water company recommended and how many the plaintiffs participated in to keep them safe from their drinking water.
The New Jersey state court disagreed with the company and found the plaintiffs had met the requirements for class-action certification.
